These Terms & Conditions of Sale apply to purchases made from Monarch Access Products Ltd.

2. Definitions

In these Terms:

“We”, “us” or “our” means Monarch Access Products Ltd.

“You” or “your” means the person or organisation placing an order with us.

  • Product packaging or labelling may differ from images shown.

4. Prices

Prices displayed on our website are those applicable at the time of ordering.

Unless otherwise stated, prices are displayed excluding VAT where applicable.

10. Delivery Charges

Applicable delivery charges will be displayed at checkout or otherwise communicated before the order is confirmed.

Additional delivery charges may apply where a delivery requires specialist arrangements, is outside our standard delivery area or requires additional handling.

Where additional charges are required, we will communicate these before applying them wherever reasonably practicable.

11. Inspecting Your Order

You should inspect Products as soon as reasonably practicable following delivery.

If Products appear damaged, incorrect or incomplete, please notify us as soon as possible.

We may request photographs or other information to help us investigate the issue.

12. Damaged, Incorrect or Faulty Products

If you receive a Product that is damaged, incorrect, incomplete or appears to have a manufacturing fault, please contact us as soon as possible.

We may request photographs, product details, serial numbers, batch numbers or other information reasonably required to investigate the issue.

We will then advise you of the appropriate next step.

13. Product Use and Suitability

Products must be used in accordance with the manufacturer’s instructions and applicable safety requirements.

You are responsible for ensuring that Products are suitable for your intended application and are used appropriately.

Where Products require specialist installation, inspection, maintenance, training or other arrangements, you are responsible for ensuring these requirements are met unless we have expressly agreed otherwise in writing.

Nothing in these Terms affects any rights or remedies that cannot legally be excluded.

14. Manufacturer Warranties

Where a Product is covered by a manufacturer’s warranty, the terms of that warranty will depend on the relevant manufacturer and Product.

A manufacturer’s warranty does not affect any rights or remedies you may have under applicable law.

Where appropriate, we may assist with communicating warranty claims to the manufacturer.

15. Returns and Refunds

Our Refund & Returns Policy explains the process for requesting a return, replacement or refund.

Products should not be returned without following our returns procedure unless otherwise agreed.

Certain Products may be subject to specific return conditions, particularly Products that have been customised, specially ordered, altered, used or supplied specifically to a customer’s requirements.

This does not affect any rights or remedies that cannot legally be excluded.

16. Cancellation

If you wish to cancel an order, please contact us as soon as possible.

If the order has not yet been processed or dispatched, we will make reasonable efforts to accommodate the cancellation.

If the Products have already been dispatched or supplied, our Refund & Returns Policy will apply.

Nothing in these Terms is intended to exclude any cancellation rights or other legal rights that cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Subject to this, we will not be responsible for losses arising from:

  • Failure to follow manufacturer instructions
  • Use of Products outside their intended application
  • Unauthorised modification or alteration of Products
  • Incorrect installation or maintenance carried out by others
  • Information supplied incorrectly by the customer

Where permitted by law, we will not be liable for indirect or consequential losses.

Nothing in these Terms affects any rights or remedies that cannot legally be excluded or limited.

18. Events Outside Our Control

We will not be responsible for delay or failure to perform our obligations where this is caused by circumstances outside our reasonable control.

  • Flood
  • Industrial disputes
  • Transport disruption
  • Supply chain disruption
  • Manufacturer delays
  • Government action
  • Changes in law
  • Power or telecommunications failures
  • Cybersecurity incidents
  • Other events beyond our reasonable control

We will take reasonable steps to minimise the impact of such circumstances.

19. Ownership and Risk

Unless otherwise agreed in writing, ownership of Products will pass to you once we have received full payment for those Products.

Risk in the Products will pass in accordance with the agreed delivery arrangements and applicable law.

20. Intellectual Property

Nothing in these Terms transfers ownership of intellectual property belonging to Monarch Access Products Ltd or a third-party manufacturer.

21. Data Protection

We process personal information in accordance with our Privacy Policy.

22. Complaints

If you have a complaint about an order or Product, please contact us as soon as possible.

We will investigate the matter and aim to resolve it fairly and promptly.

24. Governing Law

These Terms & Conditions of Sale are governed by the laws of England and Wales.

The courts of England and Wales shall have jurisdiction in relation to disputes arising from these Terms, subject to any rights or requirements that cannot legally be excluded.
